1. Definitions and Scope
These Terms and Conditions ("Terms") constitute a legally binding agreement governing access to and use of the website www.garibaich.com, its mobile applications, and all related services, features, tools, and content (collectively, the "Platform"). The Platform is owned and operated by GariBaich (Private) Limited, a company incorporated under the laws of the Islamic Republic of Pakistan ("GariBaich", "Company", "we", "us", or "our").
By accessing, registering, or using the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms, the Privacy Policy, and all policies incorporated herein by reference.
Use of the Platform is strictly limited to individuals who are eighteen (18) years of age or older and legally competent to enter binding contracts.
2. Acceptance Through Click-Wrap Mechanism
By clicking the "I Agree", "Sign Up", "Register", or similar acceptance button, or by continuing to access or use the Platform, you expressly consent to be legally bound by these Terms. Such electronic acceptance shall constitute a valid and enforceable agreement under applicable laws of Pakistan, including the Electronic Transactions Ordinance, 2002.
3. User Registration and Accounts
Certain services require account registration. You agree to provide accurate, complete, and current information and to update such information as necessary.
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account. GariBaich shall not be liable for any loss or damage arising from unauthorized use of your account due to your negligence.
You must immediately notify GariBaich of any unauthorized access or security breach.
4. User Content and Conduct
Users may submit listings, descriptions, images, and related materials ("User Content"). By submitting User Content, you represent and warrant that:
- You have lawful ownership or authorization to post such content.
- The content is accurate, lawful, and not misleading.
- The content does not violate intellectual property, privacy, consumer protection, PECA 2016, or any other applicable law.
- The content does not involve fraud, misrepresentation, harassment, or illegal activity.
GariBaich reserves the unrestricted right to review, edit, restrict, suspend, or remove any User Content without prior notice.
5. License to Use User Content
You grant GariBaich a non-exclusive, royalty-free, worldwide, transferable license to host, use, reproduce, publish, display, and distribute User Content solely for the operation, marketing, and improvement of the Platform. Ownership of User Content remains with you.
6. Paid Services and Fees
Certain features may require payment. All fees are non-refundable, unless expressly stated otherwise in writing. Fees are subject to change without prior notice.
Payment does not guarantee sale, purchase, verification, or completion of any transaction.
7. Role of Platform and Risk Allocation
GariBaich operates solely as a technology-based marketplace and facilitator. The Company does not own, inspect, verify, sell, purchase, or finance vehicles, nor does it act as a broker, dealer, agent, or financial institution.
All transactions are entered into at the sole risk, responsibility, and discretion of users.
8. Third-Party Services and Links
The Platform may contain links to third-party websites or services. GariBaich does not control or endorse such third parties and assumes no liability for their content, policies, or practices.
9. Intellectual Property Rights
All Platform content, trademarks, software, logos, and branding are the exclusive property of GariBaich or its licensors. No rights are granted except as expressly stated herein.
Unauthorized reproduction, distribution, or exploitation is strictly prohibited.
10. Suspension and Termination
GariBaich may suspend or terminate access to the Platform, with or without notice, for violation of these Terms, applicable laws, or regulatory requirements.
11. Disclaimer of Warranties
The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, GariBaich disclaims all warranties, express or implied, including accuracy, reliability, merchantability, fitness for a particular purpose, and uninterrupted availability.
12. Limitation of Liability
To the fullest extent permitted by law, GariBaich shall not be liable for indirect, incidental, consequential, special, or punitive damages, loss of profits, data, or business opportunities, or disputes between users.
13. Indemnification
You agree to indemnify, defend, and hold harmless GariBaich, its directors, officers, employees, and affiliates from any claims, losses, liabilities, damages, costs, or expenses arising out of your use of the Platform, User Content, or violation of these Terms.
14. Dispute Resolution and Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms or the use of the Platform shall first be attempted to be resolved through good faith negotiation.
If unresolved within thirty (30) days, the dispute shall be finally settled by arbitration in accordance with the Arbitration Act, 1940. The seat and venue of arbitration shall be Lahore, Pakistan, and proceedings shall be conducted in English. The arbitral award shall be final and binding on the parties.
15. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Subject to the arbitration clause, courts at Lahore shall have exclusive jurisdiction.
16. Amendments
GariBaich reserves the right to amend these Terms at any time. Continued use of the Platform constitutes acceptance of the revised Terms.

We may collect personal data (including name, contact details, CNIC where legally required), vehicle information, transactional data, and technical usage data.
2. Legal Basis and Use of Information
Information is collected and processed in accordance with PECA 2016 and applicable consumer protection laws for the purpose of operating the Platform, facilitating transactions, preventing fraud, and complying with legal obligations.
3. Data Sharing
Personal data is not sold. Data may be shared with service providers under confidentiality obligations, regulatory authorities required by law, or with user consent.
4. Data Security
Reasonable technical and organizational safeguards are implemented. However, no system is completely secure, and absolute protection cannot be guaranteed.
5. Data Retention
Personal data shall be retained only for as long as necessary to fulfill legal, contractual, or operational purposes.
6. User Rights
Subject to applicable law, users may request access, correction, deletion of personal data, or account deactivation.
7. Policy Updates
